You can resign from your job under the conditions set by the Act of 3rd July 1978 related to employment contracts (in compliance with a notice to your employer).
In this case you would normally be disqualified from receiving unemployment allowances for a certain period of time (ranging from 6 to 52 weeks), which also amounts to be deprived during the same period of social security coverage.
In this case, you will not qualify for unemployment allowances during the period you are taking care of your child but, if this period exceeds six months, you can keep your entitlement to these allowances for a certain period of time.
1) You do not ask for unemployment allowances and you take care of your child.
To be eligible for unemployment allowances, the full-time worker must complete a probationary period of a certain number of working days during a defined period of time in accordance with your age. The reference period is extended by the number of days of inactivity of at least six months to raise a child or an adopted child.
Thus, if you are between 36 and 50 years-old, you are to prove 468 days of performed work (or assimilated) during the 27 months preceding the application for unemployment allowances. If you resign to take care of your child, these 27 months will be increased by the number of days during which you took care of your child (as long as the duration exceeds 6 months) This extension applies only to the periods before the sixth birthday of the child (or before his eighteenth birthday, if an increased family allowance was granted due to a handicap of the child).
2) You apply for unemployment allowances and benefit from at least 1 day of allowances.
You can be readmitted to the benefit of unemployment allowances without having to prove again your working days, if you send your application no later than three years after your last day of compensation. This period is extended by the period of inactivity which took place before the sixth anniversary of the child or before the eighteenth birthday, if an increased family allowance has been granted due to the handicap of the child.
